Buying Windows 11 Pro for Less: What to Watch For

A Windows 11 Pro key for a few euro can be entirely lawful. Microsoft’s own Dutch store listed the licence at €259.00 on 8 August 2026, and the gap between those two numbers is explained by a 2012 ruling of the Court of Justice of the European Union. What almost nobody quotes is the sentence in that same ruling that makes a large share of cheap keys unlawful.

That sentence is about splitting. Get it, and you can sort the legitimate offers from the rest in about a minute, without knowing anything else about licensing. Miss it, and price is all you have to go on, which tells you nothing at all.

The ruling everyone cites and the part they skip

The case is UsedSoft GmbH v Oracle International Corp, C-128/11, decided by the Grand Chamber on 3 July 2012 (ECLI:EU:C:2012:407). The full text sits on EUR-Lex and was read for this article on 8 August 2026.

Oracle’s position was that Article 4(2) of Directive 2009/24/EC, which exhausts the distribution right on first sale in the Union, applied only to physical discs. Download it and no sale had occurred, so nothing was exhausted. The Court disagreed. Where the rightholder has granted a right of use for an unlimited period against a fee corresponding to the economic value of the copy, the distribution right is exhausted for that copy, downloaded or not.

Two conditions travel with that. The first acquirer has to make their own copy unusable at the moment of resale. And the second acquirer, along with everyone after them, counts as a lawful acquirer under Article 5(1), which means they may download the software from the rightholder’s own website and receive updates.

Is buying a second hand Windows key legal?

Inside those conditions, yes. Outside them the ruling offers no cover at all, and the boundary is sharper than the general talk about a “grey market” suggests.

Why splitting is where the cheap market breaks

That last row is the one that gets left out, and it is the one that matters most. The Court said plainly that where the licence acquired covers more users than the first acquirer needs, exhaustion does not give them the right to divide it and sell off the remainder.

Picture what that rules out. An organisation holds a volume agreement with a single key good for several hundred activations. Somebody turns that into several hundred separately sold “licences”. One licence was paid for and hundreds were sold. That is not resale, it is duplication wearing resale’s clothes, and no ruling protects it.

What is a MAK or volume key?

MAK stands for Multiple Activation Key: a corporate key with a fixed pool of activations attached. The awkward part is that it works. Yours will activate, Windows will report itself genuine, and nothing will look wrong for months.

Then the activation pool runs dry, or the agreement it came from lapses, and on an ordinary Tuesday a watermark appears telling you Windows is not activated. At that point the seller is a defunct storefront and you own nothing. The failure is delayed, which is exactly why the market can keep selling them.

A seller doing this properly buys whole licences from organisations that are winding down, with the paperwork that records the transfer, instead of carving up a volume key. It is slower and it earns less. It is also the difference between something that still works in three years and something that does not. Coming from Windows 10? Check before you buy anything

Many people land on this page for one reason: support for Windows 10 ended on 14 October 2025 and something has to happen. If that is you, do not start with a purchase.

Upgrading from Windows 10 Home or Pro to the equivalent Windows 11 edition is free where the machine meets the minimum requirements, and your existing activation carries across. A licence is only needed for a clean install, for a machine built without an operating system, or to move from Home up to Pro.

If the hardware is too old to qualify, there is a middle route. The consumer ESU programme supplies security updates through 12 October 2027, and in the European Economic Area Microsoft offers two ways to enrol where the United States gets three. Provenance beats price as a signal

The ruling covers a narrow set of facts: a licence of unlimited duration, first sold inside the Union, passed on whole, with the previous holder’s copy made unusable. Step outside any one of those and you are somewhere the judgment does not reach.

A subscription is outside it, because it has an end date. A key sourced from outside the Union is outside it, because exhaustion operates within the internal market. A volume agreement chopped into pieces is expressly outside it, as above.

Which is why a seller who understands the trade tracks where each batch came from and records that the previous holder gave it up. None of that admin is visible on the product page, and it is the only real difference between two offers that look identical in your browser. Ask about it. A seller with no answer does not have one.

Settle the edition before you shop on price, because Pro is more than most home users will ever touch.

What the judgment left open

It is worth being straight about the edges, because sellers on both sides of this argument tend not to be. UsedSoft settled the central question: a perpetual licence, sold once inside the Union, can move on to a new owner, and that owner is entitled to use it. It did not settle everything that gets sold under that banner.

Keys that shipped preinstalled with a particular machine sit in a different category, since their terms tie them to that hardware rather than to a person. Keys sourced outside the Union sit outside the internal market the doctrine operates in. Neither is settled by pointing at a 2012 judgment about database software, however often that judgment gets waved around.

The practical consequence is small but real: keep your invoice. Not because anyone is likely to come knocking at a private address, but because an invoice naming the seller is the thing that turns a key in your inbox into a purchase you can point to. Businesses in particular should treat that as filing, not paperwork, since an audit asks for records rather than for keys.

Four checks before you pay

  • Is there a company behind the shop, with an address, a registration number and an invoice in your name? A seller who is only an email address can do nothing for you in six months.
  • Is there help if activation does not take on the first attempt, or does the relationship end when the code is sent?
  • Is there a refund policy, written down somewhere you can point at later?
  • Does the seller explain anywhere where the licences come from? Silence on that point is usually deliberate.

One thing not worth checking: whether the price seems too low. It is not a signal, and treating it as one leads people to the wrong conclusion in both directions. A lawful second hand licence and a carved up volume key both cost a few euro, and plenty of overpriced keys are no better sourced than the cheap ones. The difference sits with the seller, never with the number.

When not to buy

Three situations where the answer is no, or not yet.

If Windows is already activated on the machine and everything works, buy nothing. A second licence for the same computer adds nothing. Open Settings, System, Activation and read what it says first.

If you are unsure whether the machine can run Windows 11 at all, check the hardware before you buy a licence you may not be able to use. The obstacle is nearly always TPM 2.0, and on a great many computers from 2016 onwards it is present but switched off in the firmware. Enabling it costs two minutes and nothing else.

And if the computer belongs to your employer, buy nothing here at all. That machine sits inside a managed environment and your own key will only cause trouble. It is a question for whoever administers it.

After you pay

The key arrives by email. Enter it under Settings, System, Activation, then Change product key. Usually it is done inside a minute and the page reports that Windows is activated.

When it refuses, the message is rarely the end of it. Codes such as 0xC004C003 and 0xC004F074 tend to mean the activation servers have not caught up or that phone activation is needed, not that the key is dead. The steps and the common errors are collected in activating Windows 11.

One thing to do straight away, and it is free: link the licence to your Microsoft account once activation succeeds. Replace a motherboard later and Windows treats the machine as a different computer, dropping activation with it. With an account attached you reverse that yourself through the activation troubleshooter. Without one it becomes somebody else’s decision, and you find that out at the worst possible moment.
